1. Detailed description of goods and/or services:
   1. eCiggies is a business in the Vape Industry that sells Vape Hardware and e-Liquid.
2. Delivery policy:
   1. Subject to availability and receipt of payment, requests will be processed within 1-3 days and delivery confirmed by way of courier (The Courier Guy / Pargo) tracking.
3. Export restriction:
   1. The offering on this website is available to South African clients only.
4. Return and Refunds policy:
   1. The provision of goods and services by eCiggies is subject to availability. In cases of unavailability, eCiggies will refund the client
      in full within 30 days. Cancellation of orders by the client will attract a 7% administration fee.
5. Customer Privacy policy:
   1. eCiggies shall take all reasonable steps to protect the personal information of users. For the purpose of this clause, "personal
      information" shall be defined as detailed in the Promotion of Access to Information Act 2 of 2000 (PAIA). The PAIA may be downloaded from: http://www.lawsofsouthafrica.up.ac.za/index.php/current-legislation.
6. Payment options accepted:
   1. Payment may be made via Visa or Master Cards or by bank transfer into the eCiggies bank account, the details of which will be provided on request.
7. Card acquiring and security:
   1. Card transactions will be acquired for eCiggies via PayGate (Pty) Ltd who are the approved payment gateway for all South African
      Acquiring Banks. DPO PayGate uses the strictest form of encryption, namely Secure Socket Layer 3 (SSL3) and no Card details are stored on the website. Users may go to www.paygate.co.za to view their security certificate and security policy.
8. Customer details separate from card details:
   1. Customer details will be stored by eCiggies separately from card details which are entered by the client on DPO PayGate’s secure site.For more detail on DPO PayGate refer to www.paygate.co.za.
9. Merchant Outlet country and transaction currency:
   1. The merchant outlet country at the time of presenting payment options to the cardholder is South Africa. Transaction currency is
      South African Rand (ZAR).
10. Responsibility:
    1. eCiggies takes responsibility for all aspects relating to the transaction including sale of goods and services sold on this website,
       customer service and support, dispute resolution and delivery of goods.
11. Country of domicile:
    1. This website is governed by the laws of South Africa and eCiggies chooses as its domicilium citandi et executandi for all purposes under this agreement, whether in respect of court process,
       notice, or other documents or communication of whatsoever nature:

    1. eCiggies may, in its sole discretion, change this agreement or any part thereof at any time without notice.

GUARANTEE / RETURN POLICY:

1. eCiggies offer a 60 day guarantee on all guaranteed items purchased except for e-liquids.
2. Guaranteed items are batteries, Mod's and chargers
   The 60 day guarantee period starts from the date of purchase.
3. Faulty items will be exchanged with new, similar items.
4. Faulty items must be returned to us within the 60 day period via Courier/Postnet or similar with tracking number, and the tracking number must be e-mailed to us within the 60 day period.
5. Replacement parts will be send to the client via Courier.
6. eCiggies does not accept phone calls or e-mails as proof that items are faulty.
7. eCiggies does not accept any returns on any e-Liquid or CBD product.
8. eCiggies will not replace items that has already been replaced within the 60 day period.
9. When items are replaced, the replacement parts do not carry a new 60 day guarantee, the 60 day guarantee is still applicable from the original date of purchase.
10. eCiggies does not offer ANY guarantee on ANY Cartomiser / Disposable Atomiser / Clearomizer
11. eCiggies does not offer ANY guarantee on RBA's / RDA's.
12. eCiggies does not offer refunds under any circumstances.
13. eCiggies DOES NOT offer a "use and test" guarantee, if a client buys a product and is not happy with the performance, it CANNOT be returned, purchased items

(excluding atomizers / clearomizers / coils / Liquid ) can only be returned if the items are faulty AND faulty items will be replaced with the same item (if returned in the guarantee period).

Any item for sale on eCiggies may only be purchased by persons 18 years or older. The Buyer will be asked when placing the order to declare that they are of the legal age to purchase the goods. The seller shall be entitled to cancel the order, without notice, should the Seller discover that the Buyer is not legally entitled to order goods.

The prices of goods are the prices stipulated on the Website. The prices are inclusive of VAT. The prices excludes delivery charges. The full order amount needs to be paid before goods will be dispatch. EFT payments must reflect in the bank statements of eCiggies before goods will be send.

The Seller shall use its reasonable endeavors to meet any date agreed for Delivery. The Seller shall not be liable for any losses, costs, damages or expenses incurred by the Buyer or any third party arising directly or indirectly out of any failure to meet any delivery date. Sent parcels are not insured and it is up to the Buyer to carry insurance costs, should the Buyer wish to insure parcels. The option for Insurance will be given before final checkout in the ordering process. Title and risk in the Goods shall pass to the Buyer upon delivery of the Goods.

The seller reserves the right to update prices on the Website. The seller reserves the right to withdraw any goods from the Website at any time.

The Seller shall under no circumstances be liable for any direct, indirect, incidental or consequential loss or damage whatsoever.

The Seller shall not be liable for any delay or failure to perform any of its obligations if the delay or failure results from events or circumstances outside its control, including but not limited to Acts of God, strikes, accidents, war, communications failure, telecommunications or computer system failures. The Seller shall be entitled to a reasonable extension of its obligations.

The Seller shall be entitled to alter these Terms and Conditions at any time.

The Terms and Conditions shall be governed by South African Law and the parties hereby submit to the jurisdiction of South African Courts.

Products sold on this site is intended for adult smokers (18+ years). You must be of legal smoking age to purchase products. Please consult your physician before use. E-Liquids on our site may contain Propylene Glycol and/or Vegetable Glycerin, Nicotine and Flavorings. Our products may be poisonous if orally ingested. Products sold by eCiggies are alternative smoking products and are not advertised as smoking cessation products and have not been evaluated by the Food and Drug Administration, nor are they intended to treat, prevent or cure any disease or condition. For their protection, please keep out of reach of children and pets. Read our terms and conditions page before purchasing our products. Use all products on this site at your own risk!

Buyer means the individual or organisation that buys or agrees to buy goods from the seller. Contract means the contract between the Seller and the Buyer for the sale and purchase of Goods incorporating these terms and conditions.

Goods means the items that the Buyer agrees to buy from the Seller:

Buyer means the client who places the order via the website, sms, telephone call or any other means.
Terms and conditions means the terms and condition of sale set out in this agreement and any special terms and conditions agreed in writing by the seller.

These Terms and Conditions shall apply to all contracts for the sale of Goods by the Seller to the Buyer and shall prevail over any other documentation or communication from the Buyer. Acceptance of Goods (by Delivery) shall be deemed conclusive evidence of the Buyer’s acceptance of these Terms and conditions. Any variation of these Terms and conditions shall be inapplicable unless agreed to, in writing by the Seller. Any complaints can be e-mailed to eCiggies (info@eciggies.co.za).

All orders for Goods shall be deemed to be an offer by the Buyer to purchase Goods pursuant to these Terms and Conditions and are subject to acceptance by the Seller.
Where ordered Goods are not available from stock the Buyer shall be notified and given the option to either wait / replace the item with items of similar value or receive a refund.
